Reminder: The REALTOR® Cooperation Policy Comes into Force January 2024
On January 3, 2024, the REALTOR® Cooperation Policy comes into force, putting into effect the new “Duty of Cooperation” in Article 30 of the REALTOR® Code.
Under the policy, REALTORS® are required to place their property listings on an MLS® System within three (3) days of public marketing, unless an exemption applies. The policy also requires REALTORS® to inform their seller clients of the benefits of marketing their listing on an MLS® System – and, if the seller decides to forego this option, that they confirm the decision in writing.
Boards and associations are responsible for enforcing the REALTOR® Code with their members and the new “Duty of Cooperation” provides the authority to enforce REALTOR® Cooperation under existing REALTOR® Code enforcement procedures.
To support boards and associations ahead of January 2024, the Canadian Real Estate Association (CREA) will continue to provide resources and information at CREA.ca/REALTORCooperation, starting with updated FAQs and a template REALTOR® Cooperation Disclosure and Consent form (attached) you can use as-is, customize to your specific requirements, or integrate into existing forms.
